These terms and conditions are the legal background for the relationship between AFRIBET and you, our players. It is applied to our products, services and online betting facilities that we offer.

Although AFRIBET and its proprietors make every effort to keep information in the retail outlet and or hosted on the website accurate and current as well as in accordance with gambling guidelines and legislation, we can’t be held responsible for:

·        Liability for any damages

·        Gambling addictions

·        Side effects

·        Adverse effects

·        Medical complications

·        Injury

·        Death arising from the use of any information available on its website.

By making use of any of this retail outlet or website, the player or user warrants that he or she is older than 18 years. Any person 18 years or older can operate an AFRIBET online sports betting account. Proof of identity, age and residency is required prior to opening any account.

·        Any injury, loss, claim, loss of profits, opportunity or revenue, loss of business or agreements, loss of goodwill, loss of use or corruption of software, loss or corruption of data or loss of anticipated savings;

·        Loss or damage to property, or injury;

·        General damages or any direct, indirect, special, incidental, consequential, exemplary or punitive damages of any kind.

General Terms:

It is Your responsibility to ensure that You are aware of the current terms and conditions in place at the AFRIBET retail outlet and or website.

AFRIBET reserves the Right to change the Terms and Conditions at any time without notice.

Should any such changes materially affect Your rights, AFRIBET will attempt to notify You of the changes to the Terms and Conditions by Email.

Acceptance of the Terms and Conditions:

Whenever you visit a retail outlet and or view the AFRIBET website, play any game or make any wager or bet, you agree to be bound by, and such actions constitute acceptance of and agreement to, the Terms and Conditions as posted on the AFRIBET website or available in the retail outlet on request at the time of the action.

Whenever you place any wager or bet, in any sports market or contingency offered by AFRIBET, you agree to be bound by, and such an action constitutes acceptance of and agreement to, the Rules, Terms and Conditions of that market or game.

·        The acceptance of any bonus, promotion, special offer, wager or bet settlement, or other credit to Your account constitutes acceptance of and agreement to the Rules, Terms and Conditions under which that credit was provided

You specifically acknowledge, agree and accept that AFRIBET is not liable for the following:

·        The accuracy, completeness or currency of any information services provided including without limitation, prices, runners, times, results or general statistics or any live scores, statistics and intermediate results shown on the AFRIBET website and or retail outlet;

·        Acts or omissions by a third party whom you have authorised to gain access to the AFRIBET online sports betting website on your behalf;

·        Any link contained, or the website or content contained, on any internet sites linked to and from the website.

·        IT failures which are caused by the hardware or software equipment which you are using to access the AFRIBET online sports betting website and or retail outlet;

·        Any defamatory, offensive or illegal conduct of any customer or third party;

·        Any loss, including any loss of winnings, arising from the use, abuse or misuse of your account or any of AFRIBET products and services, whether by you or a third party acting on your behalf;

·        Any loss, including loss of winnings, incurred in the sending of information to our website by you or by a third party acting on your behalf;

·        Any technical failures, system breakdowns, defects, delays, interruptions, manipulated or improper data transmission, loss or corruption of data, communications' lines failure, distributed denial of service attacks, or bugs or viruses or any other adverse technological consequence to betting facilities on the AFRIBET website and or retail outlet.

AFRIBET reserves the right to close any account, whether it be a result of more than one account opened by you, or malicious use and bet placement on your behalf. AFRIBET also reserves the right to refuse any pending bet it finds malicious.

You acknowledge and agree that all trademarks, logos, domain names, database rights and all related software, including content published or used on it is the intellectual property of AFRIBET

SPECIFIC TERMS AND CONDITIONS THAT RELATE TO RETAIL AND ONLINE SPORTS BETTING FACILITIES

Betting rules are available on and in-store upon request.

The terms and conditions hereof create the legal background for the relationship between the parties (i.e. AFRIBET and you as the customer) and shall be applied in respect of all the products, services and betting facilities that AFRIBET offers.

The minimum stake per transaction NGN 100 and all transactions may only be made in Nigerian Naira.

Any person 18 years or older can place a bet and or operate an AFRIBET betting account. Proof of identity, age and residency will be required prior to opening of any account.

While every effort will be made to accommodate you, AFRIBET, reserves the right to refuse or limit any wager.

No bet may be cancelled, changed, or modified by you, in any way, once it has been received and accepted by AFRIBET.

All winnings shall be credited to your account for online clients and for retail outlet to be collected at the Afribet retail outlet

Account balances are your responsibility and shall be checked at every opportunity.

Winning bets have to be claimed within14 days of the final settlement date. Any bets claimed after this 14-day period will not be paid out. (only for AFRIBET retail outlets)

Match results will stand as per the referee's result after completion of the match. Subsequent appeals and reversals of match results by the competition organisers will not be taken into account for settlement purposes.

SELF-EXCLUSIONS

At any time, the Customer may request to our Customer Service temporary or permanent self-exclusion from part or all of our services as well as the closure of his/her account. We will use all our reasonable endeavours to ensure compliance with self-exclusion; however, you accept that we are not liable if you manage to by-pass our security measures in circumstances which are beyond our reasonable control.

RETAIL OUTLETS GENERAL RULES

These rules shall apply to bets on horse races, sporting events or any lawful contingency placed with or through the bookmaker (“the Operator”).

These rules do not constitute an offer by the Operator to any person to place a bet on the bookmaker and accordingly, the Operator shall not be obliged to offer any bet type provided for in these rules at any particular race meeting or for any particular horse race, sporting event or lawful contingency.

LOST OR MUTILATED TICKETS: No claim shall be recognized or entertained in respect of a lost or mutilated ticket unless the Operator in its internal control procedures provides otherwise.

PRESCRIPTION: No claim for payment of winnings or for refund shall be admitted unless made within the period prescribed (in the relevant legislation) of the date of issue of the ticket, unless the Operator in its internal control procedures provides otherwise.

Monies unclaimed within the prescribed period after the date of issue of a ticket shall be forfeited and accrue to and become the property of the Operator subject to payment of the prescribed tax.

PAYMENT OF WINNINGS: Subject to the provisions of these rules, payment of winnings shall commence as soon as possible after each event has been decided, results confirmed and declared "official”.

COMPLAINTS: No complaint either in regard to the correctness of a ticket, the correctness of change or the payment of winnings shall be entertained unless it is made before the complainant leaves the teller/Operator’s window.

MINORS: No bet may be made by or on behalf of a minor and no winnings shall be paid to a minor or to anyone on behalf of a minor.

LIMITATION OF LIABILITY: The Operator or any Steward, Official, Member, Independent Authorised Contractor, Agent or Employee shall not be liable for damages resulting from any breach of contract or any act relating in any way to fixed-odds betting for which they are responsible either directly, indirectly, vicariously or in any way, and in particular none of the aforementioned shall be liable in damages either directly, indirectly, vicariously or in any other way for loss, destruction or disappearance of any original betting ticket, or for any error made by any of the aforesaid persons, except in a case of gross negligence.

PROHIBITION OF STAFF BETTING: No employee, whether permanent or temporary of the Operator is entitled to participate, either directly or indirectly, in any way whatsoever in any Fixed odds betting.

CONFIDENTIAL: Information and details gained with regard to any type of betting transaction are strictly confidential and no employee of the Operator may divulge such information unless in the course of duty.

ONUS ON CUSTOMER AND WAIVER OF CLAIM: The onus is on the customer to ensure that a bet slip is correctly completed and that the ticket issued corresponds with the selections requested on that bet slip or in the case of a verbal bet that such ticket issued corresponds to the bet called by the said customer or in the case of a telephone bet that the bet called back by the Operator corresponds to the bet called by the said customer. The Operator shall prominently display this requirement at all of its betting outlets.

ASSISTANCE  BY  STAFF:  Staff  who  offer  any advice  on  betting  and/or  assistance to customers in the completion of any bet slip or in the issue of any ticket in accordance with these Rules, shall not be liable for failure to comply with the requirements of such customer, nor shall any claim lie against the Operator.

The Operator likewise is not bound contractually for any default or omission caused by any member of staff dealing with a customer

ACCOUNT OPENING

Client is required to provide correct information, e.g. name, surname, physical address, valid email address

In order to place any wager or bet at AFRIBET Online, you must open an account with AFRIBET Online.

AFRIBET Online does not permit accounts to be opened by, or used from, customers based in certain jurisdictions where online gaming and gambling is not legal. These jurisdictions may change from time to time without notice.

In order to be a client of AFRIBET Online You must be 18 years of age or of the age at which gaming and gambling are legal under the law or jurisdiction that applies to You.

 The Opening of an AFRIBET Online account represents and warrants to AFRIBET Online that:

Failure to provide suitable documentation when requested may result in Your account being suspended or closed.

Your personal details (including your email address) will not be passed to any third party by AFRIBET Online. All account information data is held in a secure sever location operated by a Licenced 3rd Party and remains confidential.

AFRIBET Online will send a confirmation and verification email to the email address You supply.

MULTIPLE ACCOUNTS

Existing AFRIBET account holders are not permitted to open a new account with AFRIBET.

Should AFRIBET believe, using its absolute and sole discretion, that you have:

    1. registered and/or used more than one account; and/or
    2. acted in collusion with one or more other individuals through a number of different AFRIBET accounts to back the same combination of selections (regardless of whether or not such bets are struck separately, at a range of different prices or on different days)

in an attempt to exceed the maximum pay-out for an individual account holder across linked accounts, it reserves the right to withhold any winnings arising from such behaviour.

 

 

LIMITS

AFRIBET imposes those win limit amounts as set out below, which limits are made up of

·        A daily overall win limit, the details of which are set out below.

·        Win limits in respect of different contingencies, which are set out in the tables below.

·        The win limit amounts are imposed so as to limit the financial exposure of AFRIBET.

Although the win limit amounts are imposed by AFRIBET by it instructing the software computer programme to capture such impositions, it is unfortunately possible that this capturing does not take place and/or is captured incorrectly and/or changes in win limit imposition amounts take place for any other reasons, examples whereof are:-

  • human error / fraud (a person unlawfully changes the limits and/or “mistypes” into the computer system incorrect limit imposition amounts, or an employee authorises a transaction which he/she did not have authorisation to do so); and
  • the malfunctioning of the computer hardware and/or the software computer programme.

In the event that the win limit impositions, (as indicated in the schedules hereinunder), are exceeded, for any reason whatsoever, then AFRIBET shall be entitled, at any time, to amend the betting transaction/s concerned in order to bring same within the win limit imposition/s – AFRIBET shall furthermore have the right to reverse any credit that has been credited to your account and where necessary to credit the account with any amount wagered, which crediting is necessary as a result of the amendment of a betting transaction to bring it within the imposed win limit amount.

In many instances AFRIBET does not “take back” totalisator betting transactions (commonly known as the “open bet”) from the South African Tote Operator. Accordingly, you have the added advantage of receiving a dividend higher than that dividend You would obtain from the Tote Operator if you had placed the betting transaction concerned with the Tote Operator. However, notwithstanding the win limit impositions regarding Totalisator betting transactions, a further limit is imposed in regard to such betting transactions i.e. You cannot receive a betting transaction totalisator dividend which exceeds the net pool relative to that particular betting transaction e.g. if the net pool on a horse racing event is NGN1000 (one thousand Naira) and You place a NGN1000 (one thousand Naira) stake on a particular horse which then wins at a Tote dividend win amount of NGN10 (ten naira), You will not be paid NGN10 000 (ten thousand Naira) but rather NGN1000 (one thousand Naira), and further any winnings are always subject to the daily overall win limit.

 In addition to the win limit imposition amounts AFRIBET, in its sole and unfettered discretion, shall be entitled to impose on specific customers, and more specifically their account, a further win limit imposition amount, which win limit imposition amount it will endeavour to convey to the customer concerned. In the event that, and notwithstanding the internet software computer programme of AFRIBET having being instructed to reflect and impose a win limit imposition amount as regards a specific customer, the software computer programme accepting an unauthorised offer from the customer concerned, then in such event AFRIBET shall be entitled to change the betting transaction (at any time) in order to bring such transaction within the customer’s win limit imposition amount.

 SPECIFIC TERMS AND CONDITIONS IN REGARD TO WIN LIMIT IMPOSITION

You acknowledge, agree and confirm that all betting transactions with AFRIBET shall be subject to the win limit impositions and the daily overall win limit indicated in this Part

 You acknowledge and confirm that when communicating with the software computer programme of AFRIBET that You are submitting an offer to transact a specific betting transaction.

You undertake not to submit any betting transaction offer which exceeds the win limit impositions indicated in the schedules in this Part (hereinafter referred to as a “Prohibited Offer”).

You acknowledge that it is possible that the computer software programme (due to an error/malfunction) of AFRIBET and/or the conduct / misconduct of its employees and/or agents may result in AFRIBET accepting your betting transaction offer (notwithstanding your undertaking indicated in limits or error )and notwithstanding that such offer exceeds the win limit impositions indicated in the schedules in this Part.

You agree that should you breach the undertaking indicated  and should AFRIBET accept a prohibited offer from you then in such event AFRIBET, in its sole discretion, shall be entitled at any time (before, during and/or after the sporting event) to void / cancel the betting transaction alternatively shall be entitled to reduce the betting transaction win limit amount so as to bring it within the maximum win limit imposition amount as indicated in the schedules in this Part.

You agree (applicable to account holders only) that should AFRIBET credit the account with an amount relative to a successful betting transaction which exceed a win limit imposition amount then AFRIBET shall be entitled at any time, in its sole discretion to debit the Account with an amount by which the win limit amount has been exceeded.

You agree that should AFRIBET impose a maximum win limit imposition amount on you relative to the Account but that should you exceed the win limit imposition amount (for any reason whatsoever including human error/fraud and/or the malfunction of the hardware and/or computer software programme of AFRIBET) then AFRIBET shall be entitled, at any time, to amend the betting transaction concerned and to bring it within the customer’s win limit imposition amount.

BETTING TRANSACTIONS IN REGARD TO DIVIDENDS AS DECLARED BY THE TOTALISATOR / TOTE IN SOUTH AFRICA (COMMONLY KNOWN AS THE “OPEN BET”)

An open bet is a bet, other than a bet taken with a licensed Totalisator / Tote, accepted by a bookmaker on one or more contingencies, in which no fixed odds are agreed at the time the bet is placed, or a bet in respect of which the pay-out is determined after the outcome of the contingency on which such a bet is struck became known, with reference to dividends generated by a Totalisator / Tote.

Notwithstanding what dividend is declared by the South African Totalisator / Tote, the maximum amount payable by AFRIBET shall be those amounts indicated in the schedules immediately indicated hereinunder and numbered and always subject to the overall daily win limit set out below.

Open Wins and Open Place Limits:

Irrespective of the size of the pool of the South African Totalisator / Tote, AFRIBET reserves its right to limit the odds payable on open wins and open places to a maximum of 50% over the fixed odds starting price of the horse. The payout limit will be the lesser of the pool size and the value of the stake applied at the odds limit, and always subject to the overall daily win limit e.g. if a horse has a starting price of 3/1 and pays NGN 10 for a win on the Totalisator / Tote, and the pool size was NG N10 000.00, and a customer has NGN1 000 wins, then the payout will be limited to odds of 9/2.  Should a customer have had R5 000 wins on the horse then the maximum win amount will be the pool size.

 Carryovers:

Should there be no winning tickets in respect of the pool of the Totalisator / Tote but a customer has placed a winning bet with AFRIBET, AFRIBET will pay a dividend determined by dividing the pool by the number of customers who have placed winning bets with AFRIBET. AFRIBET's maximum liability, in totality, to customers shall be limited to the total amount in the pool, and always subject to the overall daily win limit.

Where a partial carryover is declared by the Totalisator / Tote on an open bet, on non-commingled pools, AFRIBET shall pay its winning customers based on the value of the total pool. AFRIBET' maximum liability shall be limited to the total pool. These dividends and payouts will be subject to the overall daily win limit.

Where a partial carryover is declared by the South African Totalisator / Tote on an open bet on commingled pools on international races, AFRIBET shall pay the dividend declared by Totalisator / Tote in respect of any winning bets placed with AFRIBET.  However, the liability shall be limited to the value of the pool paid out and NOT the value of the total pool. and always subject to the overall daily win limit.

HORSE RACING WIN LIMITS

WIN LIMIT IMPOSITIONS IN REGARD TO BETTING TRANSACTIONS IN REGARD TO HORSE RACING EVENTS THAT ARE TO COMMENCE IN THE FUTURE

In the event that you wish to place a fixed odd’s bet on a Horse Racing event, You are required to make AFRIBET an offer in respect of such bet, which offer is subject to AFRIBET’s acceptance.

AFRIBET shall confirm the win limit imposition in respect of such bet at the time that such bet is accepted by AFRIBET.

A bet placed in terms of this clause shall always subject to the daily overall win limit set out below.
